Spanish court rules miniature replicas that reflect a sponsor’s logo do not infringe the sponsor’s mark

Red Bull GmbH, the energy-drink company headquartered in Austria, lost its court bid to stop a maker of toy racing cars from using its logo. According to Bloomberg, Red Bull had asked for a 9% of game sales royalty.

Red Bull’s sponsorships in car racing included having their logo displayed on the cars. Tecnitoys replicates the racing cars, advertising logos and all, for their games, and they pay 4-10% of net sales royalty to the car makers for that right.
